Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

By agreeing to these Terms of Service, you represent that you are at least the legal age dictated by your State or Province in regard to the purchase and / or use of smoking and / or smoking-related products. California residents must be 21 when purchasing any smoking and / or smoking-related products or services from HeavenLeaf, and must be 18 or over in any other state or province, provided that the state or province does not dictate a different age regulation in relation to the purchase and / or use of smoking and / or smoking-related products.

You may not, in any circumstance, purchase any products from HeavenLeaf that are intended to be smoking and / or smoking-related products if you are under the legal age of smoking determined by your federal and local laws. No individual under 18 is permitted to purchase any HeavenLeaf smoking and / or smoking-related products. By doing business with us, you agree that you are at least the minimum legal age to purchase and / or use smoking products as determined by the laws that govern your country, state, and locality. We are not responsible for any liabilities should you provide false identification or lie about your age.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

SECTION 5 - PRODUCTS OR SERVICES

HeavenLeaf’s products, including but not limited to Teabacco, are solely made of natural tea leaves, USP vegetable glycerin, natural sugar syrup, and natural flavorings. There is no presence of tobacco or nicotine in any of our products. Our products may contain USP grade propylene glycol and / or caffeine naturally derived from tea.

HeavenLeaf’s products, including but not limited to Teabacco, are classified under the United States Harmonized Tariff Schedule (HTSA) as schedule 0902.40.00 labeled “other black tea”, unless specifically stated otherwise, and follow all federal and international policies, procedures, and guidelines. Any of our customers purchasing and using our products, including government officials such as customs and border protection agents, please take notice of our ingredients and the fact that HeavenLeaf does not fall into the category of a “tobacco product” or a product containing nicotine. Proof from independent laboratory results for the lack of presence of tobacco and nicotine in our Teabacco products may be provided to you upon request.

HeavenLeaf’s products, including but not limited to Teabacco, are not a safer alternative to conventional tobacco. Smoking in general poses many health risks, including but not limited to, respiratory failure, cancer, and reproductive harm.

Please note that the use of Teabacco in any way shape or form, and both with or without natural botanicals, is done at your own voluntary risk. HeavenLeaf is not liable for any consequences, including but not limited to damages of any kind, that may result in the use of Teabacco.

HeavenLeaf Infusion is a product line derived of Teabacco, and contains an infusion of natural botanicals with the main active botanical being the Areca Nut. The Infusion line contains all the same risks as Teabacco, and includes other risks associated with the consumption of Areca Nut. By voluntarily choosing to use the Infusion line, you agree that you have read and are aware of the below WebMD risks associated with using Areca Nut, and hold HeavenLeaf and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any liability and / or claim. 

According to WebMD, risks associated with using Areca Nut include but not limited to the following: 

"When taken by mouth: There isn't enough reliable information to know if betel nut is safe to take in small doses or for a short time. But betel nut is LIKELY UNSAFE when taken long-term or in high doses. Some of the chemicals in betel nut have been associated with cancer. Other chemicals are poisonous. Eating 8-30 grams of betel nut can cause death."

"Chewing betel nut can make your mouth, lips, and stool turn red. It can cause stimulant effects similar to caffeine and tobacco use. It can also cause more severe effects including vomiting, diarrhea, gum problems, increased saliva, kidney disease, chest pain, abnormal heart beat, low blood pressure, shortness of breath and rapid breathing, heart attack, coma, and death. It's LIKELY UNSAFE for anyone to take betel nut by mouth for more than a short time. But betel nut is especially dangerous for people with the following conditions:"

"Pregnancy and breast-feeding: Taking betel nut by mouth is LIKELY UNSAFE. Betel nut can affect the central nervous system and this might endanger a pregnancy. Chemicals in betel nut might pass into breast milk and harm a nursing infant. Stay on the safe side and avoid using betel nut if you are pregnant or breast-feeding."

"Asthma: Betel nut might make asthma worse."

"Slow heart rate (bradycardia): Betel nut might slow down the heart beat. This could be a problem in people who already have a slow heart rate."

"Heart disease: People with heart disease might have an increased risk of having a heart attack if they use betel nut. If you have heart disease, do not use betel nut."

"Gastrointestinal tract blockage: Betel nut might cause "congestion" in the intestines. This might cause problems in people who have a blockage in their intestines."

"Stomach ulcers: Betel nut might increase secretions in the stomach and intestines. There is concern that this could worsen ulcers."

"Lung conditions: Betel nut might increase fluid secretions in the lung. There is concern that this could worsen lung conditions, such as asthma or emphysema."

"Seizures: There is concern that betel nut might increase the risk of seizures."

"Urinary tract obstruction: Betel nut might increase secretions in the urinary tract. There is concern that this could worsen urinary obstruction."

"Drying medications (Anticholinergic drugs) interacts with BETEL NUT
Betel nut contains chemicals that can affect the brain and heart. Some drying medications can also affect the brain and heart. But betel nut works differently than drying medications. Betel nut might decrease the effects of drying medications."

"Some of these drying medications include atropine, scopolamine, and some medications used for allergies (antihistamines), and for depression (antidepressants)."

"Various medications used for glaucoma, Alzheimer disease, and other conditions (Cholinergic drugs) interacts with BETEL NUT
Betel nut contains a chemical that affects the body. This chemical is similar to some medications used for glaucoma, Alzheimer disease, and other conditions. Taking betel nut with these medications might increase the chance of side effects."

"Some of these medications used for glaucoma, Alzheimer disease, and other conditions include pilocarpine (Pilocar and others), donepezil (Aricept), tacrine (Cognex), and others."

"Medications for depression (MAOIs) interacts with BETEL NUT
Betel nut might increase the amount of a chemical in the brain. This chemical is called serotonin. Some medications used for depression also increase serotonin. Taking betel nut with these medications used for depression might cause there to be too much serotonin. This could cause serious side effects including heart problems, shivering, and anxiety."

"Some of these medications used for depression include phenelzine (Nardil), tranylcypromine (Parnate), and others."

"Doxorubicin (Adriamycin, others) interacts with BETEL NUT
There is some concern that betel nut might cause mouth sores in people being treated with doxorubicin for cancer. Until more is known, avoid betel nut if you are being treated with doxorubicin."

The use of Teabacco is in no way less harmful than other conventional types of smoking, and any and all risks associated with smoking may be associated with Teabacco. Although Teabacco may be considered an alternative to conventional tobacco, Teabacco still poses the same risks normally associated with conventional tobacco. Teabacco is in no way shape or form healthier, safer, or less dangerous than conventional tobacco.

No claims, representations or warranties, whether expressed or implied, are made by HeavenLeaf as to the safety, reliability, durability and performance of any of our companies' products. Furthermore, our company accepts no liability whatsoever for the safety, reliability, durability and performance of any of our companies' products.

In no event shall our company be liable for any direct, indirect, punitive, incidental, special consequential damages, to property or life, whatsoever arising out of or connected with the use or misuse of our products.

HeavenLeaf’s products, including but not limited to Teabacco, abide by all federal, state, provincial, and local jurisdictions. HeavenLeaf makes every effort to abide with all laws and regulations, and shall continue to abide by any new laws and regulations as required.

Any statement made by HeavenLeaf, whether physically or digitally, have not been evaluated by the Food and Drug Administration. No product made by HeavenLeaf is intended to diagnose, treat, cure, or prevent any disease.

Teabacco is not intended for edible consumption, so do not ingest under any circumstances.

Although Teabacco does not contain any nicotine or tobacco, it is important to adhere to various SURGEON GENERAL’S WARNIGNS in relation to smoking, and note that the same risks listed by the Surgeon General may be risks associated with the use of Teabacco:

• Smoking Causes Lung Cancer, Heart Disease, Emphysema, And May Complicate Pregnancy.
• Quitting Smoking Now Greatly Reduces Serious Risks to Your Health.
• Smoking By Pregnant Women May Result in Fetal Injury, Premature Birth, And Low Birth Weight.
• Cigarette Smoke Contains Carbon Monoxide.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

SECTION 4 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SMS Terms & Conditions:

Opt into SMS marketing and notifications occur by entering your phone number in the checkout page and initializing a purchase, subscribing via a subscription form, or texting a keyword. By opting into SMS marketing notifications, you agree to the following terms and conditions: You understand and agree that consent is not a condition for any purchase. You understand and agree that your phone number, name, and purchase information will be shared with our SMS marketing platform. Returns
We care about our customers, and want to ensure that you are 100% satisfied with the products and services of HeavenLeaf. Please contact us at info@heavenleaf.com for issues with your product. Please read the FAQ page for packing & use instructions so that we can ensure the proper packing and usage of all HeavenLeaf products. If, we are unable to meet your needs after contacting us to try and resolve your issues, simply return the product within 30 days of purchase back to our return address for a full refund on the product price. The product must not have been extensively or more than reasonably used in order to qualify for a refund. We ask that you return the product so that we may investigate the product for any discrepancies in quality, and to further assure that you receive the best quality products and services from us every time.

There are certain situations where only partial refunds are granted. Every situation is different and will be resolved on a case-by-case basis.

Refunds
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. Again, we highly suggest contacting us to resolve your issues before we agree on processing a refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds (if applicable)
If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.

Exchanges
We only replace products if they are defective or damaged from the factory. We are not responsible for damages caused by mishandling of the product by anyone other than HeavenLeaf themselves. Gifts
If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he will find out about your return.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you may vary.

If you are shipping any item, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

Shipping policy

All HeavenLeaf orders are processed within 3 to 5 business days (excluding weekends and holidays) after receiving your order confirmation email. Depending on what flavor you purchase and the quantity, processing times may be greater since we freshly pack every order by hand to ensure you get the highest quality product and the best experience possible.
Once our team has gotten your order ready and packed, you will receive another notification once your order has been shipped. This notification may be through email or text, depending on which method you agreed to and being contacted, and will include a tracking number from the respective shipping method used.

COVID-19 and shipping delays
Due to COVID-19, expect potential delays in shipping. Many of the shipping companies we work with, including USPS, UPS, FedEx, and DHL, have been experiencing significant shipping delays. These delays are completely out of our control, and unfortunately there is nothing we can do about any potential delays. The most accurate and up-to-date information is given by your tracking number on your chosen shipping company’s website.
These are tough times for all of us, so we greatly appreciate your patience.

Domestic Shipping Rates

In order to get the most accurate shipping rates for your specific order, please add your items to your cart, and go all the way to check out. After you input your shipping address in the checkout section, the most accurate rates for your specific address and specific cart shall be given. If you wish to see how adding different items affects your shipping cost, simply add or remove products from your cart, and go to the checkout page again to recalculate the estimate of your shipping. This is the most accurate form of shipping estimation costs.

Local delivery
We do not offer local delivery at this time. Please check with your local smoke shop, hookah lounge, or any other establishment if they offer HeavenLeaf products.

International Shipping
We offer international shipping to most countries. To find out if we can ship our products to your country, either add the items to your cart and enter your information on the checkout page, or please contact us so we can check manually.

Your order may be subject to import duties and taxes (including VAT), which are incurred once a shipment reaches your destination country. HeavenLeaf is not responsible for these charges if they are applied and are your responsibility as the customer.

Due to the fact that HeavenLeaf’s products may be considered restricted and/or may have additional fees imposed due to customs and or duties of your respective country, it is your responsibility to research any and all fees and restrictions before ordering any of HeavenLeaf’s products. We do every effort to be able to ship to your country, however, just because we are able to ship to your country does not necessarily mean the shipment will arrive without any damage or additional fees, or even arrive at all.

We have had many instances of shipments being seized by customs and border control of countries outside of the United States, and we cannot control any aspect of what happens to the shipment once it leaves US borders. We sincerely apologize for this, but it is out of our hands and not our responsibility, so you must do your research before ordering if you live in a country or territory outside of the United States.

We are not responsible for any loss and/or damage, nor any additional fees other than your standard shipping charges at checkout that may be imposed on your shipment. Please understand that these damages and/or fees are not controlled by us nor created by us. We have no control over any fees and/or damage or loss that may occur to your shipment because we cannot control what happens to your shipment once it leaves our hands.

How do I check the status of my order?
When your order has shipped, you will receive an email notification from us which will include a tracking number you can use to check its status. Please give about one or two days so that the tracking number can be updated by the shipper with the updated information about your package.

If you haven’t received your order within 7 days of receiving your shipping confirmation email, please contact us at info@heavenleaf.com with your name and order number, and we will look into it for you.

Shipping to P.O. boxes
We can ship to any PO Box within the United States, however, please check and make sure that our shipment can actually fit in your respective PO Box. We do not know how the Postal Service regulates items that cannot fit in your box, and are not responsible for any damages, loss, or shipment returns. Please confirm this information before ordering from us and shipping to PO Box.
